1. Agreement
By installing or using Smart Notes ("the App"), you agree to these Terms of Service. The App is provided by Untapped B.V., a company registered in the Netherlands ("we", "us", "our").
2. Description of service
Smart Notes is a Shopify application that enables merchants to create, manage, search, and export rich text notes attached to Shopify orders, customers, and products.
3. Eligibility
You must have an active Shopify store and agree to Shopify's Terms of Service to use Smart Notes. You must be at least 18 years old and authorized to enter into agreements on behalf of your business.
4. Free trial and subscription
Smart Notes offers a 30-day free trial with no credit card required. After the trial period:
- A subscription of $6.99 USD per month is required to create and edit notes
- Notes remain accessible in read-only mode without an active subscription
- Billing is processed by Shopify through their native billing system
- You may cancel your subscription at any time through your Shopify admin
5. Acceptable use
You agree to use Smart Notes only for lawful purposes and in accordance with these Terms. You must not:
- Use the App to store illegal, harmful, or offensive content
- Attempt to reverse engineer, copy, or redistribute the App
- Use the App in any way that could damage, disable, or impair our services
- Attempt to gain unauthorized access to our systems or other users' data
6. Your data
You retain ownership of all note content you create using Smart Notes. We do not claim any intellectual property rights over your content. See our Privacy Policy for details on how we handle your data.
7. Service availability
We aim to maintain high availability of Smart Notes but do not guarantee uninterrupted service. We reserve the right to perform maintenance, which may result in temporary unavailability. We will provide advance notice for planned maintenance where possible.
8. Limitation of liability
To the maximum extent permitted by applicable law, Untapped B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the three months preceding the claim.
9. Disclaimer of warranties
Smart Notes is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or meet your specific requirements.
10. Termination
You may terminate your use of Smart Notes at any time by uninstalling the App from your Shopify store. We may suspend or terminate your access if you violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.
11. Changes to terms
We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Continued use of Smart Notes after changes constitutes acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Rotterdam, Netherlands.
